Wills and many trusts are created to fulfill an individual’s wishes for the distribution of their assets at death. Unfortunately disputes arise over the meaning of a will or trust or the circumstances in which the document was created. In other circumstances an individual may have passed away intestate (without a will) or the individual may be incapacitated, and family members might disagree on how to handle their matters. Sometimes a personal representative, power of attorney or trustee may act in a manner that is contrary to the law or their fiduciary duty.
